Acknowledgement
These are the terms governing the use of the service and the agreement that operates between you and the Company. Your access to and use of the service is conditional on your acceptance of, and compliance with, these Terms and our Privacy Policy.
Free player account
Players must create a free account to take part. You may cancel your player account at any time, including by emailing subscriptions@kwizzbit.com with the subject line “Player Cancellation”.
Host subscriptions
Subscription period
Paid access to the service is billed in advance on a recurring basis (daily, weekly, monthly or annually). Subscriptions automatically renew on the same terms unless cancelled by you or by the Company. By subscribing you agree to pay recurring periodic subscription fees.
Online cancellations
Online subscriptions are processed through Stripe and may be cancelled at any time from the Account Details section. If you upgrade during a billing month, you pay the higher rate from the date of upgrade. Fees already paid for the current period are non-refundable, and your access continues until the end of that period.
Offline cancellations
Offline subscriptions are invoiced directly to venues or parent companies. To cancel, email info@kwizzbit.com with your account details. A minimum of one month’s notice is required. No further billing occurs after the cancellation date, and fees for the current period are non-refundable.
Billing
You must provide accurate and complete billing information, including a valid payment method. If automatic billing fails, we may issue an electronic invoice that you must settle manually by the stated deadline.
Fee changes
We may change subscription fees at our discretion, taking effect at the end of the current period. We will give you reasonable prior notice so you can end your subscription before the change applies. Continuing to use the service after a fee change means you agree to pay the new amount.
Refunds
Except where required by law, paid subscription fees are non-refundable. We may consider individual refund requests at our sole discretion.
Free trial
We may offer a free trial of some or all of the service. You may be asked for billing information to start one. Unless you cancel beforehand, you will be charged automatically at the end of the trial. We may change or withdraw free-trial terms at any time.
Promotions
Promotions may be governed by separate rules. If a promotion’s rules conflict with these Terms, the promotion rules apply.
User accounts
When you create an account you must give accurate, complete and current information. You are responsible for safeguarding your password and for all activity under your account, and you must notify us immediately of any security breach. You may not use as a username the name of another person, a name you are not lawfully entitled to use, a name subject to trademark without authorisation, or a name that is offensive, vulgar or obscene.
Content
Your right to post content
You are responsible for the Content you post — its legality, reliability and appropriateness. By posting Content you grant us the right to use, modify, display, reproduce and distribute it through the service. You retain any rights you hold in your Content and confirm that you own it or are otherwise entitled to post it.
Content restrictions
We are not responsible for the Content of users. You agree not to post Content that is unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, including material that promotes unlawful activity, is discriminatory, constitutes spam or unsolicited advertising, contains malware, infringes proprietary rights, impersonates others, violates privacy, or is false. We reserve the right to refuse, remove or edit Content at our discretion. You use the service at your own risk.
Content backups
We perform regular backups but do not guarantee against data loss or corruption. You agree to maintain your own complete and accurate copy of any Content in a separate location.
Copyright policy
We respect intellectual-property rights and respond to clear notices of alleged infringement on the service. Copyright owners or their authorised agents may send a written notice to info@kwizzbit.com describing the infringement in detail. Notices should follow standard DMCA requirements, including a signature, identification of the work and the infringing material, your contact details, a good-faith statement, and a statement of accuracy made under penalty of perjury. Misrepresenting infringement may make you liable for damages and costs.
Intellectual property
The service and its original content (excluding Content you or other users provide), features and functionality are and will remain the exclusive property of the Company. The service is protected by copyright, trademark and other laws of the Country and foreign countries. Our trademarks and trade dress may not be used without our prior written consent.
Links to other websites
The service may contain links to third-party websites we do not control. We are not responsible for their content, privacy policies or practices, and we are not liable for any loss arising from your use of them. Please review the terms and privacy policies of any third-party sites you visit.
Termination
We may suspend or terminate your account immediately, without notice or liability, for any reason — including breach of these Terms. On termination your right to use the service ceases immediately. You may end your account simply by discontinuing use.
Limitation of liability
To the maximum extent permitted by law, the Company’s and its suppliers’ total liability under these Terms is limited to the amount you actually paid through the service, or USD 100 if you have made no purchase. In no event will we or our suppliers be liable for any special, incidental, indirect or consequential damages — including loss of profit, data or business — even if advised of the possibility. Some jurisdictions do not allow certain limitations, in which case they apply to the greatest extent permitted.
“As is” and “as available” disclaimer
The service is provided “as is” and “as available”, with all faults and without warranty of any kind. To the maximum extent permitted by law, the Company disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. We make no representation that the service will meet your requirements, be uninterrupted or error-free, or be free of harmful components.
Governing law
The laws of the Country, excluding its conflict-of-law rules, govern these Terms and your use of the service. Your use may also be subject to other local, national or international laws. EU consumers benefit from any mandatory provisions of the law of their country of residence.
Disputes
If you have a concern or dispute about the service, you agree first to try to resolve it informally by contacting us.
Changes to these terms
We may revise these Terms at our discretion. For material changes we will give at least 30 days’ notice before they take effect. By continuing to use the service after revisions become effective, you agree to be bound by them. If you do not agree, please stop using the service. Where these Terms have been translated, the original English text prevails in the event of a dispute.
